Your privacy is essential for nv Plastivan (hereinafter referred to as "Plastivan", "we" or "us"). This privacy policy (hereinafter referred to as "Privacy Policy") is applicable, to (i) our websites www.duofuse.com, www.durasid.com, www.viligno.com and www.plastivan.com (hereinafter referred to as the "Websites") and (ii) all (commercial) relations between Plastivan and its customers and business partners.

Plastivan wishes to emphasize that it always attempts to act in accordance with the EU Directive 95/46/EC.

This Privacy Policy includes information about the personal data collected by Plastivan, as well as the manner in which Plastivan uses and processes these personal data. It also describes the choices available to you regarding the use of, your access to and how to update and correct your personal data.

Visiting the Websites and using the contact form published on it implies your express approval of the Privacy Policy and consequently how we collect, use and process your personal data.

Which personal data do we collect and process?

Plastivan may collect and process the following types of personal data from you:

  • Name, address and other contact details, including but not limited to phone number and email address
  • Communication preferences
  • Outgoing correspondence data.

Plastivan also automatically collects anonymous information regarding your use of the Websites. As such, Plastivan shall, for example, automatically log which sections of the Websites you visit, which web browser you use and which website you visited when you obtained access to the Websites. We cannot identify you through these data, but it allows Plastivan to draw up statistics regarding the use of the Websites.

How do we collect the personal data?

We may collect personal data about you when you provide it to us through the contact form, over the phone or by mailing it to us.

The personal data collected will be used to communicate with you and to help us provide our services to you.

Plastivan can also use your personal data for:

  • Sending targeted marketing, advertising and updates based on your communication preferences
  • Issuing invoices and collecting payment
  • Optimizing the quality, management and content of services and the Websites.

How long do we store your personal data?

Unless a longer storage period is required or justified (i) by the law or (ii) through compliance with another legal obligation, Plastivan shall only store your personal data for the period necessary to provide services to you.

With who do we share your personal data?

Plastivan shall not disclose your personal data to third parties, unless:

  • It is necessary in the context of providing services and optimizing them (including but not limited to maintenance works, payment processing, the delivery of services to Plastivan (e.g. subcontracting) and database management)
  • Plastivan has obtained your permission to this end.

If it is necessary that Plastivan discloses your personal data to third parties in this context, a data processing agreement will be completed, which requires the third party to use your personal data in accordance with the provisions of this Privacy Policy.

Notwithstanding the foregoing, it is however possible that Plastivan discloses your personal data:

  • To the competent authorities if Plastivan is obliged to do so under the law or under legal or future legal proceedings and to safeguard and defend our rights
  • If Plastivan, or the majority of its assets, are taken over by a third party, in which case your personal data shall be one of the transferred assets.

Any transfer of personal data outside the European Economic Area (EEA) to a recipient whose domicile or registered office is in a country which does not fall under the adequacy decision enacted by the European Commission, shall be governed by the provisions of a data transfer agreement, which shall contain (i) the standard contractual clauses, as referred to in the 'European Commission decision of 5 February 2010 (Decision 2010/87/EC)', or (ii) any other mechanism pursuant to privacy legislation, or any other regulations pertaining to the processing of personal data.

How do we protect your data?

Plastivan undertakes to take reasonable, physical, technological and organizational precautions in order to avoid (i) unauthorized access to your personal data, and (ii) loss, abuse or alteration of your personal data.

Notwithstanding Plastivan's security policy, the checks it carries out and the actions it proposes in this context, an infallible level of security cannot be guaranteed. Since no method of transmission or forwarding over the internet, or any method of electronic storage is 100% secure, Plastivan is, in this context, not in a position to guarantee absolute security.

How to control usage of your data?

Upon request Plastivan will provide you with data about whether we hold any of your personal data. In case your data changes, you can request to correct, update or remove the data that you gave us, by sending an email at privacy@plastivan.com.

Please understand that if you choose to decline the Privacy Policy it will prevent the sharing of your data, and Plastivan may be unable to provide services to you.
